SatPhone Shop Terms and Conditions

User agreement

  1. By visiting and/or using the SatPhoneShop.com website, associated services and functionality ("the website") you agree to be bound by this user agreement ("agreement").
  2. This agreement is formed between you and SatPhoneShop Pty Ltd (ABN 40 099 121 276) of 5/8 Anzed Court, Mulgrave, Vic 3170 Australia ("us", "our", "we"). "you", "user", "member" and "visitor" means anyone who visits this website.
  3. If you do not agree to any provisions of this agreement, you must not use the website.
  4. We reserve the right to make changes to this agreement from time to time at our sole discretion. By continuing to use the website, you agree to be bound by the changes. We are not obliged to notify you of any changes but we will endeavour to alert you to any significant changes. Nevertheless, you should check our published agreement and policies from time to time to acquaint yourself with the current version

Registration

  1. In order to make purchases and access some features of the website, you will need to be a registered member.
  2. You may not use another member's account without permission.
  3. When registering to become a member and activate an account, you must provide personal information such as your name and address, and a valid email address. You agree to provide accurate and complete information and to keep this information current.
  4. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.
  5. If you suspect or become aware of any unauthorised use of your account or that your password is no longer secure, you agree to notify us immediately.

Legal Capacity

  1. By making an on-line purchase you accept these terms and conditions and acknowledge that you:
    • are over eighteen (18) years of age, and/or
    • are entering into a legal contract with us.
  2. Should we suffer any loss or damage, as a result of a transaction entered into by a minor, we reserve the right to take legal action and seek compensation for such losses from the parents or guardians of the minor who caused the order to be placed.

Supply of services to You / Termination

  1. We aim to provide a positive experience for all users and members. Accordingly, we reserve the right to change (ie alter, remove or add functionality) the website at any time. We do not guarantee that you will be able to access the website in the same way or with the same equipment or software you used prior to the change.
  2. We may stop (temporarily or permanently) providing access to the website to you, or to visitors or members generally, at our discretion and without prior notice to you.
  3. We may in our sole discretion terminate your account or restrict your access to the website. If we do this, you may be prevented from accessing all or parts of the website, your account details or other content contained in your account. We will not be liable to you or any third party for doing so.

Disclaimer

  1. We will provide services with due care and skill but we do not warrant that our services will be provided without fault or disruption. To the extent allowed by law, we exclude all liability to you or anyone else for loss or damage of any kind (however caused or arising) relating in any way to the website including, but not limited to, loss or damage you might suffer as a result of:
    • errors, mistakes or inaccuracies on the website;
    • you acting, or failing to act, on any information contained on or referred to on the website and/or any linked website;
    • personal injury or property damage of any nature resulting from your access to, and use of, the website;
    • any unauthorised access to or use of our secure servers and/or personal information and/or financial information stored on those servers;
    • any interruption or cessation of transmission to or from our website;
    • any bugs, viruses, Trojan horses or other harmful code or communications which may be transmitted to or through our website by any third party; and/or
    • the merchantability or fitness for any purpose of any product or service of any linked sites. We do not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through the website or any linked website or featured in any banner or other advertising. We will not be a party to or in any way responsible for monitoring any transaction between you and third party providers of products and services.
  2. We do not take responsibility for direct or indirect damages, or consequential losses suffered by use of fraudulent or unauthorised web address. The only authorised access point is http://www.satphoneshop with no characters before or after "www.satphoneshop.com".
  3. Where any law implies a warranty into this agreement which may not be lawfully excluded then to the extent allowed by law, our liability for breach of the warranty will at our option be limited to:
    • in the case of goods:
      • the replacement of the goods or the supply of equivalent goods;
      • the repair of the goods;
      • the payment of the cost of replacing the goods or of acquiring equivalent goods; or
      • the payment of the cost of having the goods repaired; and
    • in the case of services:
      • the resupply of our services, or
      • the payment of the cost of resupply of our services.

Use of services by you

  1. You agree to use the website only for purposes that are permitted by:
    • this agreement;
    • any applicable law or regulation; and/or
    • generally accepted practice or guidelines.
  2. You agree not to access (or attempt to access) any part of the Website by any means other than through the interface provided by us.
  3. You agree that you will not engage in any activity that interferes with or disrupts the website or the servers and networks that host the website.
  4. You agree not to, or attempt to, circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any content or enforce limitations on the use of the website or the content therein.
  5. You agree not to use, copy, distribute or commercialise content except as permitted by this agreement, by law or with our prior written consent.
  6. You understand and agree that any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities.

Information on this Website

  1. Information about products (ie goods and services) on the website is based on material provided by suppliers and product manufacturers.
  2. You understand and agree that we cannot be held responsible for inaccuracies or errors caused by incorrect information supplied to us or by manufacturers or suppliers changing product specifications without notice to us.
  3. You agree to make your own enquiries to verify information provided and to assess the suitability of products before you purchase.

Orders

  1. Products displayed on the website do not constitute an offer to sell. It is an invitation to treat only.
  2. Orders placed by you are offers to purchase particular product under the terms and conditions in this agreement at the price specified (including delivery and other charges).
  3. We reserve the right to accept or reject your offer for any reason (or no reason) including, but not limited to, the unavailability of any product, an error in the price or product description, or an error in your order. In the event that we cancel your order, we will provide a full refund of any payment received.
  4. You may cancel your order only if we have not started processing it. A cancellation and re-stocking fee of up to 30% (whichever is lower) applies.  Goods purchased with Mobile Repayment Options and/or airtime contracts with Telstra are subject to Telstra's contract conditions agreed to at the time of purchase.

Price

  1. The prices of products, delivery and other charges shown are in Australian dollars and include GST where applicable.
  2. Prices of products and services and delivery and other charges displayed on this website are current at the time of issue, but may change at any time and are subject to availability.

Payment

  1. All payments must be received in full prior to dispatch. Please read the Payment section of the website for payment options.
  2. If your payment is not received or declined by your bank or credit card issuer, we cannot hold product against your order.

Supply of product

  1. Subject to this agreement, we will supply to you the products shown on your order confirmation.
  2. You understand that we will use our best endeavours to meet stated timeframes for dispatch and delivery, however many factors can affect these timeframes and we cannot guarantee that they will always be met.
  3. Please read the Delivery section of the website for delivery options and details. The delivery times are indicative only and SatPhone Shop will not be liable for any failure to observe these delivery times.

Risk and Title

  1. We retain ownership of goods until payment is received in full.
  2. Risk in goods, such as loss or damage, passes to you upon delivery.

Change of mind returns / Store credit

  1. Your satisfaction is our number one priority however, please choose carefully as we do not refund or exchange simply because you changed your mind or the product was not what you expected.
  2. However, if you wish to return products in their original packaging and in saleable condition we will provide you with a store credit for the purchase price less delivery fee. A restocking fee of 30% will apply.
  3. Please contact us via the help centre to obtain a Return Authorisation Number as no returns can be accepted without one.
  4. We will provide you with a store credit only when we receive the returned product. Return shipment is at your expense.
  5. Store credits must be used within 12 months of issue. Store credits may only be used to purchase from SatPhoneShop.com and are not redeemable for cash.

Free Gift Promotions

During special promotions, you may receive a free gift with your purchase or as a result of participation in a competition or giveaway event. These may or may not appear on your tax invoice as a $0.00 value item. Whilst SatPhone Shop endeavours to ensure these items are of the highest quality and safety standards in accordance with Australian Law, we are unable to offer any warranty coverage for such items in the event they break or stop working as intended.

Statutory Conditions and Warranty / Refunds

  1. The Australian Consumer Law ("Law") which forms part of the Competition and Consumer Act 2010 (Cth) implies into consumer contracts certain statutory conditions and warranties which cannot be excluded, restricted or modified. These are in addition to any voluntary warranties offered by the manufacturer or supplier. Where there is a breach of such a warranty relating to goods or services, and the breach is in terms of the Australian Consumer Law, a "major" failure, then the remedy will be limited to a refund or a replacement, at your election. In all other cases, a breach of such warranty will give rise to a refund or replacement at our discretion.
  2. As supplier, we provide the following express warranties subject to the following terms and conditions:
    • We will refund or replace the product as the case may be (with us or you deciding and determining the action to be taken according to whether the failure is major or non-major, as stated above) in the circumstances and to the extent required under the Law if the product you receive does not match the sample or description, is substantially unfit for its intended or disclosed purpose or is not of acceptable quality (as defined in the Law), is unsafe, or if the alleged issue with the product is such that a reasonable consumer aware of the issue would not have acquired the product.
    • Where a refund or replacement is to be provided under the terms of this warranty, we may to the extent permitted under the Law require the return of the product to us before refunding or replacing it. We will pay for, or reimburse you for, any shipping costs to return the original product to us.
    • Replacement products are subject to the same warranties as the original.
    • You must retain your proof of purchase for any manufacturer warranty claims.
    • Refunds will be issued by direct deposit, credit card, cheque, or PayPal at our discretion.
  3. In order to obtain these remedies:
    • You must notify us within a reasonable time of supply of the goods. In this context a 'reasonable time' is from the time of supply until a time that it would be reasonable to expect the relevant failure to become apparent, considering the nature of goods. In many cases this will be 7 to 14 days, but in some circumstances may be longer.  Once contacted we will advise you of the best way to return any products. We may not accept products returned without a Return Authorisation Number.
    • Except if and to the extent the Law requires otherwise, replacement of products or refund and reimbursement of freight costs will not be made until the original product is received by us and your claim verified.
    • We aim to process refunds and replacements within 28 days of receipt by us of the original product.
    • We will not refund or replace a product where in our reasonable opinion the product has following sale to you become of unacceptable quality due to fair wear and tear, misuse, failure to use in accordance with manufacturer's instructions, using it in an abnormal way or failure to take reasonable care.
  4. Goods that develop a defect after first use may also be covered by manufacturer warranty. You may also wish to contact the manufacturer regarding returns and repairs.

  1. The Website may include links to other websites, content or resources. These linked websites, content or resources may be operated by third parties and we may have no responsibility or control over them. The existence of these links does not imply that we endorse the linked website, content or resource. You acknowledge that we have not reviewed any of these third party websites, content or resources and we are not responsible for the material contained therein.

Shipping

  1. All shipping incurs a charge in addition to the items purchase price unless specified as 'pick up' during the time of order. 
  2. For goods that are stated as having shipping included, this included shipping is not transferable to goods that are not listed as having included shipping
  3. All shipping is via standard road unless otherwise stated

SatPhone Shop aims where possible to have their couriers deliver within the nominated time frame. Delivery times are a guide and may mot be met by couriers, due to a wide range of circumstances outside both SatPhone Shop and the assigned couriers control. SatPhone Shop cannot be help liable for delays on order delivery.

Intellectual property

  1. We reserve all intellectual property rights, including but not limited to, copyright in material and/or services provided by us. Nothing in the agreement gives you a right to use any of our marketing material, business names, trademarks, logos, domain names or other distinctive brand features.
  2. Other trade marks used on the website that belong to third parties are used with permission and remain the intellectual property of the third party.
  3. You may not modify or copy the layout or appearance of the website nor any computer software or code contained in the website. You may not decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the website.
  4. If you correspond or otherwise communicate with us, you automatically grant to us an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display and distribute the content of your correspondence or communication and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content. This may include, but is not limited to, publishing testimonials on our website and developing your ideas and suggestions for improved products or services we provide.

Transfer and Assignment

  1. In the event that we merge, sell or otherwise change control of our business or this website to a third-party, we reserve the right, without giving notice or seeking consent, to transfer or assign the personal information, content and rights that we have collected from you and any agreements we have made with you.

Indemnity

  1. You will at all times indemnify, and keep indemnified, us and our directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by us arising from any claim, demand, suit, action or proceeding by any person against you or us where such loss or liability arose out of, in connection with or in respect of your conduct or breach of this agreement.

Force majeure

  1. We shall not be liable for any delay in performing any of our obligations under this agreement if such delay is caused by circumstances beyond our reasonable control.

Applicable law

  1. This agreement will be governed by and interpreted in accordance with the laws of Victoria, Australia. You irrevocably submit to the non exclusive jurisdiction of the courts of the State of Victoria, Australia.
  2. If any part of this agreement is found to be void, unlawful or unenforceable then that part will be deemed to be severable from the balance of this agreement and the severed part will not affect the validity and enforceability of any remaining provisions.

Waiver

  1. If we do not exercise or enforce any right or provision under this agreement, it will not constitute a waiver of such right or provision. Any waiver of any provision under this agreement will only be effective if it is in writing and signed by us.

Privacy and personal information

  1. We do not collect personal information if you only browse this website.
  2. When we do collect personal information, it is our usual practice to collect this information directly from you. We do that through the member registration process and when you place an order with us. Personal information may include your name, postal address, telephone number and email address.
  3. Online payments are handled by e-way and Paypal external third party service providers. We do not see or store your credit card or banking details. Please check the eway.com.au and paypal.com.au websites for details of their privacy policies and security measures.
  4. Our server may log details about any computer used to access the Website (such as the IP address, operating system and browser type), the date and time of access, and details of the information downloaded.
  5. We only use your personal information for the purposes for which you give it to us and for internal management purposes. You agree to us using your email address to send you messages concerning your membership account, any orders you place and information about the products sold by us. If you would prefer not to receive promotional or other material from us, please let us know and we will respect your request.
  6. We do not give information about you to government agencies, organisations or anyone else unless one of the following applies:
    • you have consented;
    • you would expect us to or we have told you we will;
    • it is required or authorised by law;
    • it will prevent or lessen a serious and imminent threat to somebody's life or health; or
    • the disclosure is reasonably necessary for law enforcement.
  7. You may request us to remove your personal information from our database by emailing us or using the contact form on the website.

SatPhone Shop Gift Vouchers

PLEASE NOTE:  Vouchers can take up to 24 hours to process.  Vouchers ordered after 12 noon Friday will be processed and emailed on Monday.  

Read Terms and Conditions below:

  1. SatPhone Shop gift vouchers are valid for 12 months from date of purchase.
  2. SatPhone Shop gift vouchers cannot be redeemed for cash or refunded.
  3. SatPhone Shop gift vouchers can be used on all sale and promotional items.
  4. SatPhone Shop gift vouchers can be used on all products listed on the SatPhone Shop website except 3rd party post-paid airtime.
  5. SatPhone Shop gift vouchers can be part used / redeemed with the balance remaining on the voucher for the balance of the validity.
  6. Keep your voucher secure and safe at all times.
  7. Misplaced / Lost or Stolen vouchers must be reported to SatPhone Shop immediately.
  8. If redeeming more than 1 voucher per purchase, please call SatPhone Shop for assistance.

Rental Terms and Conditions

The following terms and conditions apply to individuals and entities (the Customer) using and/or renting Communication Services and/or Equipment, including but not exclusively Iridium Satellite Communications Services provided by SatPhone Shop Pty Ltd (ABN 40 099 121 276).

Ownership agreement of Equipment and or/Services:

Renting of equipment and services from us, you agree to be bound by the following SatPhone Shop Pty Ltd Terms and Conditions. The Customer understands and accepts that all Equipment and/or Services remains the property of SatPhone Shop Pty Ltd. The customer will not lend, transfer hire, sell or anything thereof, any part of the Equipment and/or services under any circumstance. The customer may not use or permit another person to use the service in a fraudulent manner or to commit a criminal offence. The Customer agrees to provide reasonable co-operation in any investigation of unlawful use of Services and/or Equipment.

Use of Services:

The Customer acknowledges that SatPhone Shop Pty Ltd takes care to ensure that all Equipment is in correct working order prior to dispatch. SatPhone Shop Pty Ltd will accept no liability, nor pay compensation, for failure of the Equipment at any given time, or failure of the network or connection to the network. It is the Customers responsibility to read through any instruction manual(s) provided and test all equipment prior to leaving for their trip and advise SatPhone Shop of any and all issues. SatPhone shop shall bear no responsibility for failure of Customers not understanding the functionality of any Equipment and/or Service. SatPhone Shop Pty Ltd utilize the Iridium Satellite Network and other satellite/terrestrial networks as appropriate to the hardware offered at the time. Communication services maybe temporarily unavailable or limited for a number of reasons beyond SatPhone Shop’s direct control, and as such, SatPhone Shop shall not be liable to the Customer, nor shall the Customer make any claim against SatPhone Shop or its Suppliers, for any damage, loss of property, opportunity or earnings, personal injury, death or any other loss whatsoever sustained by the unavailability, delay, faultiness or failure of the Satellite Network and/or Equipment.

Renting Services and/or Equipment:

SatPhone Shop’s records indicate that the Customer has correctly completed the Credit Application form, Rental Agreement form, and all other forms required of them, and have requested the services and/or associated equipment. Orders for communication services and/or equipment maybe placed with SatPhone Shop via the following methods:

The Customer accepts full responsibility for all Equipment and/or Services rented and undertakes to use the equipment in a proper manner and in accordance with any manufacturer and/or SatPhone Shops operating instructions supplied with the hire. By agreeing to these terms, the customer acknowledges that it is their responsibility to ensure the equipment is in working condition, and that they have read and understand the Operators Instruction Guide. All orders are subject to SatPhone Shop’s approval, and Rental Kit availability.

Damage, Lost or Stolen Equipment:

The Customer is 100% responsible for any damage to the Equipment. SatPhone Shop reserves all rights to charge/debit the Customers credit card for the full replacement cost of the Equipment and/or any repairs including freight charges. In the event the Customer’s equipment is lost or stolen, the Customer should notify SatPhone Shop immediately but will still be held responsible for all replacement, repair and/or freight charges. A police report will be mandatory upon any claims towards alleged loss or theft as evidence. The Customer must not under any circumstances, undertake or attempt any repairs to the Equipment, or send the Equipment to any repair agent, without written permission prior. For the avoidance of doubt, the following charges will apply to the Customer for any lost or stolen equipment:

  • Iridium 9555 Satellite Phone - $1995
  • Iridium Extreme 9575 Satellite Phone - $2295
  • Iridium GO! - $1545
SIM Cards
  • GO! Post-Paid SIM - $20.00
  • STD Post-Paid SIM - $20.00

Customers will also be responsible for any lost or damaged accessories at the retail price as list on the SatPhone Shop website.

Billing and Payment for Services and/or Equipment:

Full payment for hire is required prior to the dispatch of equipment. All fees and charges rendered by SatPhone Shop to the customer will automatically be charged/debited to the customer’s nominated credit card upon completing the rental booking process, regardless of the actual rental commencement date, to ensure the equipment is reserved for the Customer. SatPhone Shop will issue invoices via e-mail once the booking process has been completed. A hardcopy of the invoice will also be sent with the Equipment and/or service which will include all applicable taxes levied upon the transaction. Upon returning rental Equipment and/or Services, SatPhone Shop will complete any further fees/charges or refunds/credits within 5 business days, and issue a final Tax Invoice via email. As stated under ‘Airtime Rates and Charges’, in some cases there will be delays in retrieval of airtime usage information. In such cases SatPhone Shop reserves the right to bill the customer up to 90 days after the rental agreement has finished.

Extension of Hire:

Notice of a request to extend must be submitted in writing, via fax, or e-mail to SatPhone Shop Pty Ltd 48 hours prior to the end date on the Rental Agreement. Payment of extension of hire is required on notification that hire is to be extended and will be charged to the credit card on file. Penalties may apply if the notification is received outside if this 48 hour time frame. Extension hire rates will continue at the daily hire rate specified in the customer’s Rental Agreement. SatPhone Shop cannot guarantee that the extension will be possible as the equipment maybe booked for another Customer and in such case, must be returned by the initial agreed return date. Failure to do so by the Customer will lead to the Customer being charged all losses incurred by SatPhone Shop for not being able to supply the next customer.

Delivery and Return of Equipment:

All equipment shall be shipped from our Head Office in Mulgrave, Victoria. SatPhone Shop will use commercially reasonable best efforts to comply with the delivery terms requested by the Customer. SatPhone Shop shall not incur any liability to the Customer in the event of any delay. 

All shipping incurs a charge in addition to the items purchase price unless specified as ‘pick up’ during the time of order. All shipping is via standard road unless otherwise stated. The Customer understands that all Equipment and/or services are to be returned on, or before the return date specified on the Rental Agreement. The Customer acknowledges, and is responsible, for arranging to have the Equipment shipped back to SatPhone Shop on completion of the hire term. It is the customer’s responsibility to replace the Equipment if lost or damaged in transit. SatPhone Shop reserves all rights to charge/debit the Customer’s credit card if any additional freight charges incur due to incorrect and/or over size packaging.  The Customer will be charged the daily rental rate for each day the equipment is not returned by the agreed initial return date and will be responsible for any losses incurred by SatPhone Shop due to the late return of the Equipment. The customer agrees that if the rental is not returned at 30 days, from the initial rental agreement, and no attempt to contact SatPhone Shop has been made from the customer, the rental will be deemed stolen. A police report will be filed, the unit will be blacklisted, and that the customer will be charged for the replacement of all goods associated with that rental, as well as any additional fees associated with any losses incurred by SatPhone Shop.

Early Termination and Cancellation of Rental Agreement:

Any request to terminate the rental by cutting the rental term shorter or cancelling a booking agreement, will be at the absolute discretion of SatPhone Shop if any or all monies are refunded back to the Customer less and Administration Fee of $50.00. SatPhone Shop reserves the right to still charge the Customer the full rental booking fee if the Equipment and/or Service can no longer be rented out. SatPhone Shop may terminate the Rental Agreement at any time without notice if it suspects any violation of any terms and conditions, or unlawful use, of this Agreement. The Customer shall be responsible for all charges outstanding at the time of termination.

Bond:

That Customer must provide SatPhone Shop with a Bond in such sum as we may reasonably determine. The Customer must pay the Bond in full at the beginning of the Rental Agreement. At the end of the Rental Agreement, once all Equipment and/or services have been returned and SatPhone Shop has verified that all products are correct in working condition with no damage, the Bond money will be refunded back into the Customer’s nominated credit card, less any applicable fees rendered during the rental term. The Bond amount is $100.00.

COVID:

For Rental bookings made on or after 31 May 2021, the SatPhone Shop cancellation policy will apply. COVID-19 related circumstances will no longer be accepted as a valid reason to cancel your rental whether shipped or still waiting for shipment.

After the declaration of COVID-19 as a global pandemic by the World Health Organization, any extenuating circumstances no longer applies because COVID-19 and its consequences are no longer unforeseen or unexpected.

Insurance:

The Customer is aware that Insurance is offered for Rental Equipment and/or Services. Insurance is calculated at $3.00 per day and is non-refundable. Any insurance claims for lost or stolen products must be accompanied with a police report and statutory declaration. SatPhone Shop strongly recommends the Customer to take Insurance to protect against large replacement costs in the event the equipment is damaged/lost or stolen. Depending on the equipment, and potential unauthorized airtime use of the device, prior to it being reported as stolen, can exceed over $1500. If Insurance is not purchased, the Customer will be charged the full replacement value of any missing or damaged Equipment and Accessories, and/or any unauthorized use of Services. Any insurance claims will automatically forfeit the bond on that specific product.

Standard and GO! Post-Paid Airtime Rates and Charges:

The Customer is responsible for all outgoing calls/SMS’ made within, or outside of the Rental Agreement dates while the Equipment and/order Service is in the Customers possession. The Customers credit card will be charged/debited to accommodate the call and SMS charges incurred. Unless stated otherwise, all airtime rates are charged at the current airtime rates set out by SatPhone Shop at the time the contract is signed. Call rates are specified on www.satphoneshop.com. These charges can be deducted at any time during or after the rental agreement has been completed. SatPhone Shop reserves the right to charge and calls/SMS etc. up to 90 days after the rental agreement has been completed due to delays in the satellite network operators supplying call details to SatPhone Shop. A Tax Invoice will be supplied to the customer once call and SMS charges have been finalized. SatPhone Shop reserves the right to change any airtime pricing and/or plans at any given time. Where possible, SatPhone Shop will endeavor to give affected customers 30 days’ notice of any pricing change.

Indemnify and Limitation of Liability:

SatPhone Shop will not be liable to the Customer, its agent, third parties or any other person for any indirect, consequential, incidental or special losses or damage, loss of earnings, or personal injury however arising. The Customer indemnifies SatPhone Shop Pty Ltd against any loss or damage in relation to the use of the communication services, or attempted use of the communication services by any person connected to that service.

Applicable Law:

This agreement shall be governed and construed in accordance with the Laws of the State of Victoria, Australia. The Customer agrees that this is an application to SatPhone Shop Pty Ltd (ABN 40 099 121 276) for connection to, and the rental of communication Equipment and/or Services. The Customer acknowledges that SatPhone Shop may decline the application without providing the applicant with reason.

Privacy and personal information:

  1. We do not collect personal information if you only browse this website.
  2. When we do collect personal information, it is our usual practice to collect this information directly from you. We do that through our rental process when you place a rental with us. Personal information may include your name, postal address, telephone number and email address.
  3. You consent SatPhone Shop to do an identity check against your personal details provided, with Equifax for the purpose of confirming your identity.
  4. Online payments are handled by e-way and Paypal external third party service providers. We do not see or store your credit card or banking details. Please check the eway.com.au and paypal.com.au websites for details of their privacy policies and security measures.
  5. Our server may log details about any computer used to access the Website (such as the IP address, operating system and browser type), the date and time of access, and details of the information downloaded.
  6. We only use your personal information for the purposes for which you give it to us and for internal management purposes. You agree to us using your email address to send you messages concerning your membership account, any orders you place and information about the products sold by us. If you would prefer not to receive promotional or other material from us, please let us know and we will respect your request.
  7. We do not give information about you to government agencies, organisations or anyone else unless one of the following applies:
    • you have consented;
    • you would expect us to or we have told you we will;
    • it is required or authorised by law;
    • it will prevent or lessen a serious and imminent threat to somebody's life or health; or
    • the disclosure is reasonably necessary for law enforcement.
